At 54, Johnston faces up to five years behind bars after pleading guilty to a felony charge of civil disorder. Following an initial court appearance in California last June, he was released on a $25,000 bond.

Court documents outline that Johnston was involved in obstructing officers during civil disorder and unlawfully entering restricted Capitol grounds.

Reports indicate he joined a group assaulting police officers, seen in a video taking a shield from an officer to fend off law enforcement.

According to charging documents, Johnston was near the tunnel entrance, signaling fellow rioters to join him. He acknowledged his participation in the events, describing the situation in text messages as chaotic and not originally intended as an attack.

The FBI identified Johnston from photos, supplied by three of his acquaintances, confirming his presence at the Capitol. Flight records further corroborated his involvement, showing he flew from Los Angeles to Washington DC days before and after the riot.

Apart from Bob’s Burgers, Johnston’s career includes roles on HBO’s Mr. Show with Bob and David and minor parts on Arrested Development. Sentencing is scheduled for October 7 under US District Judge Carl Nichols.
